General terms and conditions of sale
BIENVENUE! Immersion linguistique carries out its activity of language immersion stays within the framework of the Individual Company in the name of Françoise JAFFIOL-JASNIEWICZ, Identifier SIREN 881 715 643, Code APE 8559B Autres enseignements, hereafter referred to as "the Organiser".
These general terms and conditions detail the contractual relations with student clients, hereinafter referred to as "the student".
1.TERMS AND CONDITIONS OF REGISTRATION FOR STAYS AND ONLINE COURSES
The student, can send a registration request by email to info@bienvenue-il.com, or by the contact form to be completed on the website. As soon as the e-mail is received, the organizer will contact the student: the organizer will analyze the student's request and check the availability of the dates that he or she wishes. After studying the student's needs, the organizer will quickly send him/her a quote and the registration form.
On receipt of the registration form accompanied by a deposit of 30% of the price of the service (or 100% of the payment if you book less than 4 weeks before your arrival), the confirmation of the reservation will be sent to the student.
No reservation can be guaranteed without the deposit, or the full payment if the reservation is made less than 4 weeks before the student's arrival.
Language stays are not sold online, and the website http//www.bienvenue-il.com is a non commercial information site.
2.TERMS OF PAYMENT FOR STAYS AND ONLINE COURSES
The method of payment is bank transfer. When the student returns the completed registration form, the organizer will give him/her the bank details of our agency. All bank charges are to be paid by the student.
The student must send an e-mail to the organizer with a bank transfer certificate with his/her name and the invoice number.
100% of the payment must be made no later than 4 weeks before the student's arrival in the host family.
The sale will be completed upon receipt of the registration form completed and signed by the student, together with the payment of the 30% deposit.
3. NON-PAYMENT OF THE BALANCE
In case of non-payment of the balance of 70% 4 weeks before the beginning of the stay, and after this period, the organizer reserves the right to unilaterally cancel the student's stay at any time after these 4 weeks. The 30% deposit remains as a cancellation fee to be paid by the student. The organiser will inform the student by e-mail and by post with acknowledgement of receipt.
4. THE CONTRACT
The invoice paid by the student corresponds to the program and package chosen at the time of registration. The detailed content of the programs and packages is sent by e-mail to the student with a blank registration form. Each program is characterized by total linguistic immersion so that the student can perfect his or her practice of French throughout the day, with hours of classes given in the host family, as well as educational outings or excursions allowing the student to apply his or her French learning in a concrete way and in a specific cultural environment. The student also shares all meals with his or her host family, which are times for improving language skills in everyday French, and is housed under his or her own roof.
The contract does not cover :
-the student's visa fees
-the student's travel expenses to come to and from Montpellier to the host family,
-The student's personal expenses,
-The student's personal travel expenses during his or her stay and additional activities not included in the program,
-The student's entrance fees for tourist sites and those of his or her accompanying person for the outings included in the program.
-The student's personal insurance.
The organizer is responsible for the proper execution of the contract and the program that the student has purchased. Only a modification at the student's initiative, such as the refusal to go on excursions or the willingness to reduce the number of hours of classes, would release the organizer from its responsibility for the proper execution of the program.
5. CANCELLATION
Cancellation on the part of the student : Any cancellation on the part of the student must reach the organizer by registered letter with acknowledgement of receipt and by e-mail. Cancellation is effective from the date of receipt of this letter. Cancellation fees to be paid by the student are as follows:
- The deposit of 30% for any cancellation received more than 30 days before the beginning of the course,
- 50 % of the total amount if the cancellation is received 30 to 7 days before the beginning of the course
- 75 % of the total amount if the cancellation is received 7 to 2 days before the beginning of the course (Sunday after midnight for an arrival the following Sunday).
- 100 % of the total amount if the cancellation is received after Friday noon (local time) before the beginning of the course or in case of no-show on the day of arrival.
Students are advised to contact their insurance company in advance to ensure that the cancellation fee is covered, if necessary.
Cancellation by Bienvenue-il :
Cancellation of a program: The organizer can cancel a course in case of force majeure, order of the authorities, strike, unrest or other compelling reasons. The organizer will immediately refund the student the full amount of the course fees; however, he may in any case retain a compensation for the services partially provided.
If the organizer is personally and exceptionally unable to fulfil the contract signed with the student, he will propose to the student to choose another date for his language stay. If the student refuses to do so, the organiser will reimburse the student in full for the cancelled stay. No additional costs will be borne by the organizer.
6. MODIFICATIONS OF THE DATES OF STAY:
Changes are in principle impossible because they are very complicated to organise, and it is therefore on a case-by-case basis that the organiser studies requests for postponement of dates of stays already booked. The postponed stay must be of the same category and duration as the stay initially booked, and must be rescheduled within a maximum of 6 months following the dates of the stay initially planned. When a postponement is accepted, the deposit already paid is carried over to the new stay, but it is not refunded under any circumstances.
The organiser is not obliged to postpone the stay. If it is impossible to postpone a stay, the cancellation conditions apply as provided for in Article 4.
7. CHANGES DURING THE STAY
If the student changes his or her arrival or departure days slightly during the booked period, he or she is obliged to inform the organizer as soon as possible, bearing in mind that :
- in the event of early departure, any stay started is entirely due and cannot give rise to any refund, neither on the courses nor on the accommodation.
- in the event of arrival later than planned, the student cannot claim any refund and the host family is not obLiged to make up for the missed lessons.
- Changes to the programme made at the student's request, such as replacing a day of classes with a visit, cannot be discounted from the price agreed in the contract.
- Outings beyond 100 KM round trip from the residence of the host family, when requested by the student during his stay, are the subject of a separate quote which take into account the fuel costs or public transport, any meal or accommodation costs for the student and his host family.
8. ABSENCE FROM COURSES OR ACTIVITIES
If the student, during his/her stay, decides not to follow part of the courses or participate in activities (excursions, visits), or certain meals with the family, he/she cannot claim any reimbursement. Likewise, if the student is absent for one or more days for a personal trip, he or she cannot claim any reimbursement.
9. HOLIDAYS
During French public holidays (other than Saturdays and Sundays), classes are cancelled, but can be replaced in agreement with the student by a family outing.
10.LEVELS AND PROGRAMS
We offer :
-courses in the levels corresponding to the Common European Framework of Reference for Languages (CEFR): Level A0 (Beginner), Level A1 (Elementary 1), Level A2 (Elementary 2), Level B1 (Intermediate/independent 1); Level B2 (Intermediate/independent 2), Level C1 (Advanced/experienced), Level C2 (Superior/experienced).
- preparation for the DELF and DALF certification exams for the different levels.
- professional courses for contractors or their employees, on training plan.
- preparation or support courses for the integration of expatriates and their families.
11. TIMETABLE, TEACHING METHODS AND COURSE CONTENT
-Classes take place in French every morning at the home of the teacher with whom the student is staying. For online courses, the teacher and the student together decide on the course hours which can take place in the morning, afternoon or evening, according to the availability of each one.
The teacher reserves the right to exceptionally modify the lesson times, in case of necessity. The student may also request an exceptional modification of the course schedule, in case of necessity
-The host family's teacher has all the skills and experience to provide French lessons.
Before the student's arrival, the student exchanges at least two emails with his or her teacher, without using a spell checker, and, if possible, has a telephone interview. This allows the teacher to assess the student's overall level, within the CEFR frame of reference.
Then, during the first class following the student's arrival in the host family, the student takes an in-depth test of his or her level and competence in French, thanks to which the teacher can define his or her precise needs. The teacher then draws up a detailed and personalised teaching plan in consultation with the student, within the framework of the programme chosen by the student at the time of registration. The teacher takes into account the student's requests and gives him/her advice.
- The teacher keeps a daily logbook which notes in detail all the skills worked on as well as the materials used. The student signs this dashboard which will be given to him/her at the end of the stay.
- At the end of their stay, students receive a certificate of course attendance, as well as a level certificate commented on by their teacher.
-The teacher uses varied and adapted teaching aids: FLE (French as a Foreign Language) books, press articles, videos, educational games, etc.
- In case of major and exceptional impossibility of the teacher after the beginning of the stay, the teacher reserves the right to be replaced by a teacher with the same skills as him/her, without changing the conditions of the course or its quality: place, time, level, pedagogical content.
12. DIFFUSION OF IMAGES AND INFORMATION
The student is accommodated with a family, not in a hotel or holiday resort.
- No images of the students are shown in any form or on any medium. Souvenir photos must remain, for the student and the host family, in a strictly private setting.
- The student undertakes not to publish any personal information about his/her host family (photos of the house, family members, names of the hosts, etc.) on social networks or to third parties who might not respect the privacy of the host family.
13.ACCOMMODATION AND RULES OF LIFE IN THE HOST FAMILY
The student is accommodated in the family of his teacher, who is his host family. Depending on the program that the student has chosen, he or she will be alone or in a room with two people, which has its own bathroom/WC. All the information about the accommodation conditions is communicated to the student in the description of the different programs which is sent to the student with the blank registration form. The student shares all meals with his or her host family, and many moments during the day.
As a student you must respect the rules of life in your host family's house. The host family reserves the right to expel a student without refund in the event of possession, drug use, alcohol abuse, current drunkenness, vandalism, repeated disruption of classes, disturbance of the host family's peace of mind, harassment or inappropriate attitude towards people in the host family's house.
14. MINORS
Minors are supervised by the host family. However, the parents of a minor (16 to 18 years of age) must ensure that their child is sufficiently mature, independent and responsible to go out and take local public transport without adult supervision during the day, for example to spend an afternoon in town independently. Night outings are not possible for minors unless they are accompanied by an adult and responsible person known to the host family, and for a return home before midnight. These outings can only be occasional, and the parents of the minor student will have to give the host family written permission.
The parents of a minor (16 to 18 years old) are required to sign a release authorizing their child to go out without adult supervision during the day and to participate in activities organized by the host family (excursions, outings to the beach, swimming in the pool, etc.).
Parents will be required to complete and sign a certificate of authorization for the student to be taken care of by the emergency medical services in the event of an accident or health concern that may arise during the language study stay. Parents or legal representatives must also provide the host family with a telephone number where they can be reached.
For more specific activities that may present risks, and requested by the parents of the underage student (horse riding, sailing lessons, rock climbing, etc.), a request with a specific written release and a medical certificate of "no contraindications" must be completed and given to the host family.
In the event of serious breach of the rules of life by acts or behaviour as mentioned in article 13, the minor student will be sanctioned by immediate return and repatriation to his/her country without reimbursement and at the expense of his/her parents or legal representatives.
15.DATA PROTECTION
Student records are subject to data processing to efficiently manage their enrolment and follow-up. This data is for internal use only. The French law on data protection (6 January 1978 modified in 2004) gives you the right to access and correct your details and you can exercise this right by contacting us at info@bienvenue-il.com.
16. INSURANCE
The student is required to personally take out a civil liability insurance to reside with his/her host family, and it is recommended to have a health/accident insurance with the insurance company of his/her choice, in order to cover all risks (illness, theft, accident etc) to which he/she may be exposed during his/her trip to Montpellier, but also in his/her host family, during the courses and/or excursions/travels/events organised by his/her host family. The organiser declines all responsibility towards students during their stay. The E.I. Françoise JAFFIOL-JASNIEWICZ has taken out professional civil liability and operational civil liability insurance with the MAIF insurance company in order to cover all risks linked to the operation of its activities.
The organiser also recommends that the student takes out cancellation insurance with his insurer.
17. FORMALITIES
The conditions of entry and stay in a country may vary according to nationality. The student is solely responsible for carrying out the required formalities and obtaining the necessary documents (insurance, visa, passport, customs, vaccination certificate etc. ...) for his/her stay in France. Should the student be refused entry into France for failure to comply with police, health or customs formalities, the student will be solely responsible for any sanctions and/or fines that may be imposed as a result of the failure to comply with police, health or customs regulations, and the stay will be considered cancelled under the conditions of article 5.
18.COMPLAINTS/LITIGATION
Any complaints must be made by the student in writing BEFORE departure at the end of the stay in order to give the organizer the opportunity to provide appropriate solutions in consultation with the student. In the event of a dispute, the Court of Montpellier will have sole jurisdiction.
